RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

The undersigned (“Participant”) desires to participate in the Buck-a-Bird Charity Event sponsored by Gaia Home, a North Dakota nonprofit corporation (“Gaia Home”), held at Capital City Sporting Clays, LLC (“Premises”). In consideration for being permitted to participate in the event, including without limitation the use and discharge of firearms, presence on the premises, and any related activities (collectively, the “Activities”), the Participant, on behalf of themselves and their heirs, executors, administrators, and assigns, hereby agrees to the following:

1. Acknowledgment of Risk
   Participant understands and acknowledges that the Activities are inherently dangerous and involve risks, including but not limited to serious bodily injury, permanent disability, property damage, and death. These risks may result from the Participant’s actions, inactions, the actions or inactions of others, the condition of the premises, or the use and handling of firearms.
2. Voluntary Participation
   Participant affirms that they are voluntarily participating in the Activities with full knowledge of the dangers and risks involved and agrees to assume full responsibility for any injuries or damages that may occur as a result of such participation.
3. Release and Waiver of Liability
   Participant releases, waives, discharges, and covenants not to sue Gaia Home, its officers, directors, employees, volunteers, affiliates, or agents (collectively, the “Released Parties”) for any and all claims for personal injury, death, property damage, or any other loss arising from or relating to participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.
4. Indemnification
   Participant agrees to indemnify and hold harmless the Released Parties from any and all liabilities, claims, damages, expenses (including attorney’s fees), and causes of action arising out of or related to Participant’s involvement in the Activities.
5. Minors
   If the Participant is under 18 years of age, this Agreement must be signed by a parent or legal guardian. The undersigned parent or legal guardian affirms they have legal authority to sign on behalf of the minor and agree to bind the minor to the terms of this Agreement. The parent or legal guardian further agrees to indemnify and hold harmless the Released Parties for any claims arising from the minor’s participation.
6. Representations
   By signing below, Participant affirms they are not prohibited by law from possessing or handling firearms and are physically and mentally capable of safely participating in the Activities.

BY SIGNING BELOW, THE PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
