RELEASE FROM RESPONSIBILITY, WAIVER OF LIABILITY AND ASSUMPTION OF RISK FOR PARTICIPATION IN A DANGEROUS ACTIVITY

THE UNDERSIGNED desires to participate in shooting activities sponsored by GAIA HOME, a North Dakota Nonprofit Corporation, on the Capital City Sporting Clays, LLC, premises. FOR AND IN CONSIDERATION of being permitting by GAIA HOME to participate in the Buck-a-Bird Charity Event and for the purposes of firearms use, shooting firearms, observing the shooting of firearms, or any and all other purposes, THE UNDERSIGNED, for herself, himself, her/his heirs, executors, administrators and assigns:

 

1. Acknowledges that the activities taking place during the Buck-a-Bird Charity Event are potentially dangerous.
2. Acknowledges that THE UNDERSIGNED has been fully and completely advised of the potential for serious accident incidental to engaging in firearm activities.
3. Acknowledges that, NOTWITHSTANDING THE RISKS, THE UNDERSIGNED knowingly and voluntarily participates in the activity with an express understanding of the dangers involved.
4. Agrees to accept and assume any and all risks of loss, injury, and property damage that may be sustained by THE UNDERSIGNED
5. Voluntarily and knowingly releases and discharges GAIA HOME, and waives and relinquishes any and all actions against GAIA HOME for personal injury, property damage, or wrongful death occurring to the UNDERSIGNED arising as a result of engaging in or being present at the activities sponsored by GAIA HOME at the Capital City Sporting Clays, LLC, premises.
6. In the case of a minor Participant, the Undersigned parent or legal guardian acknowledges that he/she is not only signing this Agreement on his/her behalf, but that he/she is also signing on behalf of the minor and that the minor shall be bound by all the terms of this Agreement. Additionally, by signing this Agreement as the parent or legal guardian of a minor, the parent or legal guardian understands that he/she is also waiving rights on behalf of the minor that the minor otherwise may have. The Undersigned parent or legal guardian agrees that, but for the foregoing, the minor would not be permitted to participate in the Activity. By signing this Agreement without a parent or legal guardian’s signature, Participant, under penalty of fraud, represents that he/she is at least 18 years of age. If signing as the parent or guardian of a minor Participant, signing adults represent that they are a legal parent or guardian of the minor Participant.

 

THE UNDERSIGNED HAS READ THE FOREGOING PARAGRAPHS AND VOLUNTARILY SIGNS THIS AGREEMENT BEING FULLY AWARE OF THE LEGAL CONSEQUENCES OF THIS SIGNED INSTRUMENT.
